Disaster Unemployment Assistance Information

BUFFALO, N.Y. (WIVB) – For thousands, the November lake effect snowstorm was of historic proportion. Well over a month after the storm, some in parts of Erie, Genesee and Wyoming counties are still reeling.

In many ways, the storm was paralyzing, one of which was financially. People either couldn’t make it in to work or were stuck at work. And for a select few, their places of employment were destroyed by the storm.

After a recent announcement that governments would see some relief, there’s now some relief in sight for those who resided in the middle of the most devastating storm of the year.

Following the declaration by the President on Dec. 22, disaster unemployment assistance still wasn’t available. Typical unemployment benefits kick in a week after work has been missed.

But now, according to New York State Senator Tim Kennedy, people in the disaster area will be eligible for reimbursement. He says the Department of Labor waived the week long requirement.

“If an individual has lost wages because of missing work due to the storm either they were snowed in or the driving bans precluded then from getting to work, they will be eligible for reimbursement of those lose wages.” According to New York State Senator Tim Kennedy.

News 4 reached out to the Department of Labor, and they said they’re not on the same page as Kennedy.

“This disaster aid will help pay for activities like debris removal and the rebuilding of damaged public infrastructure. In addition, several loan programs are available to assist small businesses, non-profits and homeowners. Federal Disaster Unemployment Assistance was not included because FEMA’s Individual Assistance requests are solely based on the number of homes rendered uninhabitable by a disaster and the region did not meet this strict federal requirement,” Chris White, director of communications for the Department of Labor, said.

White said anybody entitled to regular unemployment benefits can apply through the Department of Labor.

Kennedy’s office claimed not everybody at the department of labor is on the same page as of yet, but they believe they will get up to speed on the new circumstances after the holidays are over. Kennedy’s office removed from their website a press release claiming the wages would be available. You can see an original copy of the press release here. 

When applying for the unemployment aid which Kennedy says will be available, those seeking reimbursement can follow the directions below:

Eligibility for making a claim breaks down as follows:

  • No longer have a job or a place to work
  • Cannot reach the place of work
  • Cannot work due to damage to the workplace
  • Cannot work because of injury caused by the storm

If those are applicable, the application process for reimbursement is as follows:

  • File an online claim for Unemployment Insurance on the Department of Labor website.
  • Then write a letter back dated to November 18, that’s the first day of the storm, explaining why you were out of work, including the last four digits of your social security number
  • Fax it to the department of labor at 518-457-9378.
